All visitors to this site (referred to herein as "client," "Member," "visitor," "you(r)," or "participant") agree to the ABCMIND Terms & Conditions contained in this page in its entirety and agree that you are solely responsible for your behavior and wellbeing and understand that ABCMIND & Company (herein referred to as "ABCMIND" or "abcmind", all of which refer to ABCMIND LLC and its products, services and websites) is meant as a resource and adjunct to, not as treatment for, your emotional, physical and/or psychological health. You agree that you are of legal age to participate (or have submitted a Parental Consent Form approving participation) and that you are not associated with any indecent activities or competitor actions.

As a visitor to ABCMIND & Company and associated websites (aka: www.abcmind.us, www.abcmind.org, www.abcmindcompany.com; herein referred to as "the website"), you agree that ABCMIND and its participating affiliates are not liable for any use of the material contained herein or for any aspect of your wellbeing and that we make no guarantees whatsoever for the use and/or effectiveness of the ideas, materials, programs, products or services contained herein or offered by ABCMIND & Affiliated Professionals. 

Please note that content included in the ABCMIND website (aka: abcmind.us, abcmind.org, abcmindcompany.com), services and products are not intended as substitution for appropriate legal, financial, mental or physical health advice/services. 

Both clients/visitors and ABCMIND & Company Professionals maintain the right to terminate the relationship between each other at any time and for any reason.

Participants in any of our phone-based or in-person Visualization and Meditation Groups, or 1-1 Psychological Coaching sessions, and/or anyone choosing to download or purchase ABCMIND products and educational materials, agree that they are voluntarily choosing to engage these services and offerings and that they are physically and mentally in sufficiently fit condition to do so.

ABCMIND professionals also maintain the right to refuse services to anyone for any reason and request consult by a professional (such as a GP or Psychiatrist) hired by the interested participant as a requisite for participation or continuation in Site Membership or Program Participation.

The trademarks, "ABCMIND," "Psychological Coaching," "CALM," "CLEAR," and "Focus for Good" AND all the content contained within our Websites, Mobil APPS and downloadable materials (including abcmind.org, abcmindcompany.com, abcmind.us © each of its pages & its design/materials, PDF's, Audio Files and Videos) are protected by the author and may not be reproduced or distributed for any reason without first obtaining permissions. TERMS OF SERVICE: ACCOUNTABLE COMMUNITY

ABCMIND LLC and its Affiliated Professionals (herein together referred to as "ABCMIND & Company" or simply "ABCMIND") partners with individuals who are motivated and oriented toward improving the outcomes in various aspects of their lives and who choose to engage with other like-minded people to practice and develop the set of knowledge and skills to accomplish what it is they have set out for themselves. abcmind both welcomes participants' ideas and offers a 'principles and skills framework' from which to begin exploration into the question, "What does harmony mean to you?" and its various implications for how we live our lives.

By joining this community in any of the ways that are offered, each person agrees to honor a shared commitment to having an "Accountable Community". For ABCMIND to be an accountable community, it means that all members, associates, practitioners and participants agree to respect the views of other members, freely share their ideas and agree that they are who they say they are. We do NOT welcome or allow "trolls," "observers," or any other form of "online lurking" whatsoever. You agree that the information you provide to ABCMIND is true and accurate to the best of your ability and agree that ABCMIND may, at its discretion, ask for further information to verify the identity of Members, Program Participants and Visitors. ABCMIND may terminate relations with (and/or bar access to) (1) anyone posing as other than who they actually are or (2) anyone deemed by ABCMIND to be causing problems for the community as defined by ABCMIND. We all agree as participants to protect the privacy of other Members as best we can, are aware that we are welcome to identify ourselves within any community spaces by first names to retain our privacy within any groups we participate, online, in-person or via phone. And that each person in the ABCMIND community is solely responsible for the relationships they make during their time with us. This way, ABCMIND can best balance the privacy and sharing between members, while behind the scenes protecting the community overall from abuses that might arise from outsiders listening in under false pretenses. This can never be 100% guaranteed, and ABCMIND makes no promises whatsoever that other Members are indeed who they say they are. In any online environment, each person must use their own judgement. However, this policy is ABCMIND's means of trying to create an environment that honors the "Accountable Community" practice as best as we possibly can while concurrently maintaining both an openness to new Members and a reasonable degree of privacy for practicing Members. ABCMIND's policy for respecting Members and Visitors private information is governed by our Privacy Policy as detailed below. 

INFORMED CONSENT

ABCMIND offers various services and educational content and provides a space for private, comfortable gatherings, where we spend regular time in a special kind of exercise. While we believe strongly in the benefit of these practices and the testimonials of our participants, we of course can make no promises as to any benefits to your overall health or well-being. However, we do guarantee your satisfaction or your money for any ABCMIND Program purchase will be refunded (per terms described below**).

At ABCMIND we work on practicing "furnishing our minds with true, good and beautiful things" (Marcus Aurelius), and moving more healthfully to nourish, strengthen and resolve what we need to in order to live well with greater satisfaction. Thus we strive to offer you the best and most enjoyable practice space and conceptual framework we can.

By signing up for ABCMIND Membership or joining any ABCMIND meeting or coaching work for a day, a month or longer, or by purchasing any ABCMIND product offered via the web, mobil APP or audio/video offering, you understand, accept and agree on the following: 

 •        You accept full responsibility for your physical, emotional and financial well-being and are in a stable position to participate in and/or purchase coaching, meditation & group work and/or related ABCMIND products. You also understand that ABCMIND meetings, services and products are in no way meant as a substitute for professional services in the treatment of any kind of illness or disorder, be it mental, physical or spiritual.

 •        ABCMIND Founder and Program Director are credentialed and part of the ethical community of professionals affiliated with the International Coach Federation and the American Psychological Association and adhere to their ethical guidelines (please read here). You understand that ABCMIND services are based in partnership with you as a success-oriented client and you agree to hold no one at ABCMIND liable for any aspect of your wellbeing. All services and information presented are on an as-is basis taken at your own risk. ABCMIND services are coaching-based and do not fall under the classification of "mental health services" and thus are not classifiable or reimbursable by insurance and not meant as a substitute for therapy, counseling or psychiatric services.

 •        You understand, acknowledge and agree (a) that meditative and yoga-like moving, stretching and breathing practices do have potential side effects (see frequently asked questions), (b) not to hold ABCMIND or its affiliates liable for any adverse reactions, and (c) have consulted a doctor who deems that you are fit to add this kind of activity to your routine.

 •        You agree to do your best to come with the attitude we try to cultivate called, "take the best and leave the rest." You agree to find "what works for you" and to speak with us if you have any problems, reservations or discomfort and to cease participation if the meetings are not a good fit for you. ABCMIND and affiliated professionals also may end the coaching relationship for any reason at any time and reserve the right to require participants to seek treatment by a medical or mental health professional (at client’s expense) as a prerequisite for continuing participation in ABCMIND meetings based on the sole discretion of ABCMIND LLC.

 •        While we encourage participants to be fully present each and every meeting and to only attend when they can give their full attention, you understand that you are free to come and go as you see fit, and to cancel at any time and for any reason. You also agree to monitor your progress and wellbeing and to cease participation immediately if you feel uncomfortable or disatissfied for any reason. While it is NOT required, ABCMIND requests an email detailing any changes in your community status with ABCMIND. Please send departure, satisfaction and request emails to support@abcmind.us.

 •    **If you purchase CALM or CLEAR sessions and are not 100% satisfied with your experience, you have one-month to request a refund for the previous month of sessions from the date of first-purchase. There will be no refunds given on any services or CALM or CLEAR meetings purchased earlier than one-month from first-date of purchase and no refunds given to clients who have been part of ABCMIND for longer than one month and have had time to learn if these services are a good fit for them. Please note that refunds are not given for missed sessions and there are no makeup sessions except at the discretion of ABCMIND. It is up to you to make the scheduled meetings. Under certain circumstances with written proof, ABCMIND may offer credit toward future classes and reserves the right to make or not make this offering as we see fit. Due to the nature of phone systems, if there are technical difficulties on the line, ABCMIND will determine whether or not to offer a makeup session at its sole discretion. Please note that no refunds will be given for One-One Psychological Coaching or Strength Testing services. 

 •     You understand that while we will do our best to protect confidentiality and personally revealing information we cannot guarantee privacy with any information shared electronically via telephone, email or text due to the nature of electronic communications. While we will identify each other by first names only, you agree to maintain the privacy of your fellow group members and to respect any personal sharing of each other’s ideas and space. You are fully responsibility for any contacts made and networking relationships that you develop during your time with us. Participants may request contact information of other group members directly with those members. ABCMIND will not share participant contact information except as required by law. We may have a space on our website for members to post their contact information and anyone who does so understands they are solely responsible for any intended or unintended uses and results of such a posting. 

 •     CALM and CLEAR Program Sessions and educational meetings may be recorded by ABCMIND. ABCMIND LLC owns the rights to the content of any recordings including the vocal participation of group members. Thus by choosing to participate you give your permission to ABCMIND to use these recordings how it sees fit and understand that ABCMIND is the property owner of all session contents. One-One Psychological Coaching and Strength Testing services are NOT recorded, unless requested to be by the client and are kept confidential within the confines of the law and constraints/limitations of electronic content management (see Privacy & Information Security Policy below).

 •        You understand and agree to honor and protect all intellectual property learned at ABCMIND and to not share this material for any reason without consent and permission from ABCMIND LLC. Participants understand and agree that they are prohibited from recording or transmitting the calls or shared information for any reason. You understand that "ABCMIND", "CALM," "CLEAR" "Focus for Good," & "Psychological Coaching" are protected trademarks and not to be used or copied for any reason without permission.

 •        ABCMIND may change the Terms & Conditions of this Informed Consent at any time, and for any reason and the changes apply to any and all years in which services are engaged. ABCMIND is not required to alert you of these changes and thus you accept responsibility for continually reviewing the ABCMIND website “LEGAL Terms & Conditions” section for updates, or by requesting the latest up-to-date ABCMIND LEGAL Terms & Conditions document at support@abcmind.us. 

 •         Upon any ABCMIND on-line Program purchase you will receive a call-in phone number and access code as well as call-in instructions. You will be required to provide us with the phone number from the phone you will be calling into the meeting with and understand that our system will disconnect any blocked callers and unauthorized/non-paid participants from the call. Also, you agree to keep the access code confidential. 

 •      Please note that when you Call-In to any Phone-Meeting via our tele-conference system, your regular long-distance phone charges will apply to the call.

 •      You have read the frequently asked questions on our website and have asked any questions you currently have at support@abcmind.us or calling us at 888-808-8909.

PRIVACY POLICY

Thank you for visiting ABCMIND. We are committed to honoring the privacy of our Members and visitors. This Privacy Policy, part of our overall Terms of Service, covers personally identifiable information shared through www.abcmind.us (or "abcmind.org" or "abcmindcompany.com", aka herein as the "website") and the data collection and use policies at our website.

• Registration
  

  The ABCMIND website requires a login in order to provide you with a personalized account. During our account registration process, we will collect a login name (which we recommend is a first name and last initial), a password (which we recommend is unique to our website and not something you use elsewhere), your Full Name (must be true and accurate), and an up-to-date, active email address from you. You must provide all of this information in order to obtain an account. (Please read Terms & Conditions: Accountable Community above) After completing our registration form, you will receive a welcome email describing your new ABCMIND account, and how to access that account. You may, at your option, also store other personal information as part of your account with our Service and you are free to cancel the account at anytime, at which point all Log-In information will be deleted from our system. Mailing lists can be opted out of directly from within any emails you receive using the "Unsubscribe" button included in all email correspondence. There are a number of possible email lists to which you may have subscribed to within the ABCMIND architecture and you will have to unsubscribe from each to close out all correspondence.

• Purchase of Services
  

  If you choose to purchase particular services and Programs offered by ABCMIND, such as but not limited to the CALM Program, CLEAR Program, Psychological Coaching, or Meditation Services, ABCMIND will not directly collect financially identifiable information (credit card number, billing address, phone number) and instead allows the secure and dedicated company with which we partner, FastSpring, to handle all billing and financial storage processing. Thus, FastSpring's Terms & Conditions, in addition to ABCMIND LEGAL Terms will apply to purchases.

• Uses of Information
  

  ABCMIND collects the aforementioned personally identifiable information in order to provide you with a service that allows you to maintain an online presence, listen to recordings, join discussions and purchase specific advanced Programs. Various features in our website management system will, at your discretion, display your User name, or adjust the date and time of events based on your locale. The ABCMIND Website Manager interface will always give you an option before any piece of your personally identifiable information is presented on your website, and situations where information will be published is made clear in various spots in the interface (for example, your name is tied to welcome emails you send out from our system, and notice of this is given to you within the interface for that tool).

  ABCMIND also uses information collected through its Service to send out notifications regarding service related issues (such as service tips, alerts, offerings, account terminations, website changes of note and other items that may impact service). We do not send contact information unless the matter is deemed urgent.   We also may use your information to send you messages regarding new services or other products from ABCMIND, but will not share this information with third parties for any marketing purposes. You agree to keep your contact details up to date for such purposes.

  Information collected through our service logs is used only to identify potential cases of abuse and establish statistical information regarding website traffic. This statistical information is not aggregated in such a way that would identify any particular user of the system.

  Any information you submit via online forms/questionnaires at the ABCMIND website is used to either improve service, provide testimonials to new members or to examine potential scientific and life questions of interest. Your name is never associated with the answers you offer to questions and instead is aggregated anonymously to get a clearer picture on the question of interest. If you provide a testimonial and we post that publicly, we only use first name and location as identifying information unless you give us permission to use your full name explicitly. We will provide an email to you with the answers you submit to any online form for your own records, which is up to your sole responsibility to protect. Upon request, the information you submit to ABCMIND will only be accessible for one month following submission. Please be aware that 100% protection of privacy of data submitted electronically can never be achieved due to the nature of such communications and ABCMIND makes no absolute guarantee to the safety of data shared online. We do however practice the best industry standards we can, because we all take privacy very seriously (see "Information Security" practices below). While we have not to date ever had any problems, you agree nonetheless to hold no one at ABCMIND liable for any aspect of information that might be leaked, misused, hacked, stolen or temporarily insecurely transmitted and fully agree that any damages or liability will be limited solely to, and will not exceed, any money you as the member have already paid to ABCMIND in the previous month from date of complaint.

  ABCMIND LLC is the sole owner of information collected on http://www.abcmind.us/ (abcmind.org and abcmindcompany.com). Your information is never shared, leased or given to any third parties in ways other than disclosed in this Privacy Policy.

• Information Security
  

  User information is stored in secure databases protected via a variety of industry-standard access controls. Secure passwords, SSL encryption, disk-based encryption, firewalls, and other measures are in place that help us to protect your data. This data is accessed only for the purposes specified in this privacy statement. We partner with a state-of-the-art hosting service that is considered an industry leader in hosting, security and reliability. Please contact privacy@abcmind.us if you would like further information on our website hosting platform.

  Lastly, please note that no information is ever 100% secure when transmitted electronically, due to the fundamental nature of telephone, digital and web-based communications. Thus, you agree to hold no one at ABCMIND liable for any breach of privacy. We do our best to stay current with the best the web industry can offer as of 2011. And leave it to your sole discretion and responsibility as to what you choose to share in ABCMIND or any online/digital environment.

   

DISCLAIMER

• Except as expressly set forth herein, and to the maximum extent permitted by applicable law, the website and all ABCMIND services are provided “as is” and are provided according to their availability, and without any guarantee, either explicit or implicit. No advice or information obtained by client from any ABCMIND correspondence shall create any representation or warranty not expressly stated in this agreement.

• ABCMIND does not guarantee that its website, service or products (herein all referred to as "service(s)) will meet your expectations, whether services are uninterrupted, convenient, safe or error-free. ABCMIND does not assume any responsibility for possible interruption or suspension of whole or parts of the features in its website and services resulting from actions or omissions by ABCMIND or a third party.

• Under no circumstances shall ABCMIND or its agents be liable to client under any theory of liability for indirect, incidental, consequential, special, punitive or exemplary damages (including such damages incurred by third parties) arising out of or in connection with this agreement, the performance of the website/services or ABCMIND's performance of the service or of any other obligations relating to this agreement or to the website, whether or not ABCMIND has been advised of the possibility of such damages, such as, without limitation, any damages resulting from loss of revenue or anticipated profits or lost business, loss of use, loss of data or any other commercial, economic, personal, mental, physical or emotional loss of any kind whatsoever. Under no circumstances will ABCMIND be liable to client for damages in excess of the price paid by client under the service.
